Content Policy

This Content Policy governs all content uploaded, created, stored, or transmitted through the KappaX Platform. This policy applies to all customers and authorized users globally and is incorporated by reference into the KappaX Software License Agreement.

These standards ensure compliance with applicable laws in India (where KappaX is headquartered) and internationally, maintain platform security and integrity, and protect the rights of all users.

Legal Framework: This policy complies with Indian laws (Information Technology Act 2000, IT Rules 2021, Copyright Act 1957) and international regulations (GDPR, DMCA, FTC regulations, and other applicable laws).

1 GENERAL CONTENT STANDARDS

1.1 Originality and Licensing
Customer warrants that all Content shall be: (a) original work created by Customer or its Authorized Users; (b) properly licensed from third parties with all necessary rights, permissions, and clearances to use, reproduce, modify, display, and distribute through the Platform; and (c) documented with licenses, permissions, and clearances available to Hyperstate upon request.

1.2 Accuracy and Truthfulness
All Content must be: (a) factually accurate and current; (b) not misleading, deceptive, or fraudulent; (c) substantiated by reliable evidence where claims are made; (d) clearly labeled if speculative, fictional, or satirical; and (e) updated promptly when information becomes outdated or inaccurate.

1.3 Quality Standards
Content must be: (a) professional quality suitable for its intended purpose; (b) functional without errors or defects; (c) complete and not truncated or corrupted; (d) appropriate resolution for intended display; and (e) optimized for performance without unnecessary file bloat.

1.4 Accessibility Requirements
KappaX Interactive Experiences (KIEs) published from the Platform should strive to meet: (a) WCAG 2.1 Level AA compliance where feasible; (b) sufficient color contrast for readability; and (c) captions or transcripts for video/audio content where applicable. These requirements apply to published output (KIEs) deployed to end users, not design files or work-in-progress Content.

1.5 Audience Appropriateness
Content must be appropriate for its intended audience, considering: (a) age appropriateness; (b) cultural sensitivity and regional norms; (c) professional context and industry standards; (d) platform terms of service; and (e) applicable content rating systems.

2. LEGAL AND REGULATORY COMPLIANCE

2.1 Indian Legal Requirements
All Content must comply with Indian laws including: Information Technology Act 2000 and amendments; IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 (prohibition on content threatening sovereignty, obscene, defamatory, invasive of privacy, or hateful content); Copyright Act 1957; Trade Marks Act 1999; Consumer Protection Act 2019; Personal Data Protection Laws; RBI Guidelines (financial services); SEBI Regulations (securities/investments); Drugs and Cosmetics Act 1940 (healthcare); Food Safety and Standards Act 2006; and any other applicable Indian laws.

2.2 International Legal Compliance
For Customers operating internationally, Content must comply with applicable laws including:

(a) European Union: GDPR, Digital Services Act, Copyright Directive, E-Commerce Directive, advertising and consumer protection regulations.

(b) United States: Copyright Act, DMCA, FTC advertising regulations, COPPA, CCPA, HIPAA (healthcare), FDA regulations, SEC regulations, CAN-SPAM Act.

(c) Other Jurisdictions: Applicable laws in countries where Content is distributed or where Customer operates.

2.3 Intellectual Property Compliance
Content must not infringe any IP rights including: (a) copyrights; (b) trademarks, service marks, or trade dress; (c) patents; (d) trade secrets; (e) moral rights; (f) database rights; and (g) fair use/fair dealing must be properly applied where claimed.

2.4 Export Control Compliance
Content must comply with: (a) Indian Export Control Order 2020; (b) U.S. EAR if applicable; (c) sanctions compliance (no content for sanctioned entities); (d) dual-use technology controls; and (e) encryption export regulations.

3. PROHIBITED CONTENT

Customer shall not upload, create, store, or transmit the following through the Platform:

3.1 Illegal & Deceptive Content

(a) Content violating any applicable law, statute, ordinance, or regulation; (b) facilitating or promoting illegal activities, drugs, controlled substances, illegal gambling, stolen goods, contraband; (c) evading law enforcement or promoting illegal hacking; (d) violating court orders or legal restrictions; (e) fraudulent schemes, scams, phishing, pretexting; (f) false advertising or bait-and-switch; (g) Ponzi or pyramid schemes; (h) investment fraud or get-rich-quick schemes; (i) fake reviews or testimonials; or (j) counterfeit products.

3.2 Infringing Content

(a) Content infringing copyrights, trademarks, patents, or other IP rights; (b) unauthorized reproductions; (c) counterfeit goods or designs; (d) unauthorized use of celebrity likenesses or endorsements; (e) plagiarized content; or (f) misappropriated trade secrets.

3.3 Harmful Content

(a) Content promoting, glorifying, or facilitating violence, terrorism, self-harm, suicide, eating disorders; (b) instructions for creating weapons, explosives, or dangerous substances; (c) content endangering or sexualizing minors in any way; (d) animal cruelty; (e) public health risks (fake medical cures); (f) inciting imminent lawless action; (g) hate speech promoting hatred, violence, or discrimination based on race, ethnicity, national origin, religion, caste, gender, gender identity, sexual orientation, disability, age, or other protected characteristics; (h) slurs, epithets, or derogatory language targeting protected groups; (i) promoting hate groups or extremist organizations; (j) harassment, threats, intimidation, cyberbullying, cyberstalking, doxing, brigading, impersonation for malicious purposes; or (k) shaming or humiliating individuals.

3.4 Adult and Sexually Explicit Content

(a) Pornography or sexually explicit content (unless explicitly permitted in writing); (b) nudity in sexual context; (c) sexual acts or services; (d) minors in sexual or suggestive manner; (e) non-consensual intimate imagery; or (f) sexualization of minors.

3.5 Misinformation

(a) Health misinformation causing physical harm; (b) election interference or false voting information; (c) crisis misinformation causing panic or harm; (d) deepfakes or deceptively edited media without disclosure; (e) harmful conspiracy theories; (f) impersonation or false representation of identity, affiliation, authority; or (g) deliberately fabricated news presented as factual.

3.6 Privacy Violations

(a) Violating privacy rights; (b) unauthorized disclosure of Personal Data; (c) content obtained through privacy violations (hacked materials); (d) unauthorized surveillance or tracking; (e) facilitating identity theft; (f) non-consensual sharing of private communications; or (g) violating reasonable expectations of privacy.

3.7 Security Threats

(a) Malware, viruses, worms, Trojan horses, ransomware, cryptojacking scripts; (b) phishing or social engineering; (c) content compromising system security; (d) exploit code or zero-day vulnerabilities (except authorized security research); (e) credential harvesting; (f) DDoS tools; or (g) backdoors or unauthorized access mechanisms.

3.8 Spam

(a) Unsolicited commercial messages; (b) repetitive or bulk messages; (c) chain letters or pyramid schemes; (d) misleading links or clickbait; (e) content farming or keyword stuffing; (f) automated or bot-generated spam; or (g) content manipulating search engine rankings.

4. INDUSTRY-SPECIFIC CONTENT STANDARDS

4.1 Healthcare and Medical Content

Must comply with: (a) HIPAA (U.S.), Drugs and Cosmetics Act (India), FDA regulations; (b) current medical consensus and evidence-based practices; (c) appropriate disclaimers for medical advice; (d) no false or unsubstantiated health claims; (e) patient privacy protection and de-identification; (f) necessary consents for patient imagery; and (g) disclosure of professional qualifications and affiliations.

4.2 Financial Services Content

Must comply with: (a) SEBI (India), RBI guidelines, SEC (U.S.), FINRA rules, AML/KYC requirements; (b) required disclosures and risk warnings; (c) disclosure of material conflicts of interest; (d) fair and balanced presentation; (e) accurate financial data and performance claims; (f) no misleading return projections; (g) no pump-and-dump schemes, market manipulation, insider trading, or unlicensed financial advice.

4.3 Children's Content

Content directed at children (under 13 in U.S., under 18 in India, or as defined by law) must: (a) comply with COPPA (U.S.), Indian data protection, GDPR (EU) for children; (b) obtain verifiable parental consent where required; (c) limit data collection; (d) be age-appropriate in language, imagery, themes; (e) not contain violence, sexual content, or profanity; (f) not exploit children's lack of judgment; (g) comply with children's advertising regulations; and (h) clearly distinguish advertising from content.

4.4 Regulated Products

(a) Alcohol: Age-gate appropriately (21+ U.S., 18+ or as required); comply with advertising regulations; not target minors; include responsible drinking messages where required.

(b) Tobacco: Comply with advertising bans and restrictions; age-gate appropriately; include health warnings where required.

(c) Pharmaceuticals: Comply with drug advertising regulations (FDA, Indian authorities); include required disclosures and risk information; distinguish prescription from OTC medications.

(d) Gambling: Comply with regulations and licensing; age-gate appropriately; include responsible gambling messages; comply with jurisdictional restrictions.

4.5 Legal and Professional Services

(a) No unlicensed legal, medical, financial, or professional advice; (b) include disclaimers for informational purposes; (c) disclose professional qualifications and licensing; (d) comply with professional ethics and advertising regulations; (e) no guaranteeing outcomes; (f) maintain client confidentiality.

4.6 Political and Election Content

Must: (a) comply with election laws and regulations; (b) comply with political advertising disclosure requirements; (c) respect blackout periods; (d) disclose funding sources; (e) identify sponsors; (f) label paid political content; (g) not spread false voting information; (h) not suppress voter turnout; (i) no voter intimidation; (j) no impersonation of election officials.

5. TECHNICAL CONTENT STANDARDS

5.1 File Formats and Specifications

5.2 Storage and Performance

(a) Individual file size and total storage capacity per Usage Limits; (b) bandwidth limits for uploads/downloads; (c) optimization required for large files; (d) compression standards to maintain quality while minimizing size.

5.3 Metadata Requirements

Content should include: (a) Descriptive: title, description, keywords, creator, dates, version; (b) Rights: copyright, license type, attribution, usage rights; (c) Technical: file format, resolution, color profile, software used; and (d) Accessibility: alt text, captions, transcripts, language tags.

5.4 Optimization

(a) Images: Appropriate compression, responsive sizing, lazy loading compatibility, next-gen formats where supported; (b) Videos: Appropriate bitrate, multiple resolutions for adaptive streaming, thumbnail generation, efficient encoding; (c) Code: Minification, efficient algorithms, reduced dependencies, performance best practices; (d) Loading: Efficient delivery, CDN compatibility, caching optimization, progressive enhancement.

5.5 Security Requirements

(a) Clean Content: Free from malware, viruses, malicious code; no embedded scripts compromising security; no unjustified obfuscated code; scanned for vulnerabilities; (b) Data Protection: Encryption of sensitive data; secure transmission; no exposed credentials/secrets; proper handling of Personal Data; (c) Code Security: No SQL injection, XSS, command injection vulnerabilities; input validation and sanitization; (d) Third-Party Components: Reputable and maintained libraries; regular security updates; vulnerability scanning; license compliance.

6. CONTENT MONITORING AND ENFORCEMENT

6.1 Hyperstate's Rights

Hyperstate reserves the right to: (a) monitor Content for compliance; (b) remove or disable violating Content; (c) suspend Customer access for repeated violations; (d) report illegal content to law enforcement; (e) cooperate with authorities and comply with legal requests; and (f) update these Content Standards as needed.

6.2 Monitoring and Reporting

Content may be subject to: (a) automated scanning and filtering; (b) manual review by moderation team; (c) user reporting and flagging; (d) random audits and compliance checks; and (e) investigation of reported violations.

Users may report violations to legal@kappax.io or through in-platform tools, including: description of violation, location of content, relevant evidence, and reporter's contact information (optional for anonymous reports).

6.3 Remediation and Appeals

Upon violation identification: (a) Customer will be notified; (b) Customer may have opportunity to cure within specified timeframe; (c) if not remediated, Hyperstate may remove or disable Content; (d) repeated violations may result in account suspension or termination; (e) violations documented in Customer's account record; and (f) Hyperstate not liable for removal of violating Content.

Appeals: Customer may appeal within 30 days by providing explanation and supporting evidence. Appeals reviewed by senior moderation team with decision communicated within reasonable timeframe. Final decision at Hyperstate's discretion with no guarantee of content restoration.

6.4 Emergency Takedowns

Hyperstate may immediately remove Content without notice if: (a) content poses imminent threat to safety or security; (b) subject to legal takedown order or court injunction; (c) facilitates ongoing illegal activity; (d) contains child sexual abuse material (CSAM); (e) violates law and exposes Hyperstate to legal liability; or (f) severely impacts Platform operations or other users.

7. USE CASE-SPECIFIC STANDARDS

Additional Content Standards specific to particular use cases may be set forth in use case-specific annexes to the Software License Agreement:

  • Advertising Use Case: Additional standards for advertising and promotional content
  • Marketing Use Case: Additional standards for marketing and campaign content
  • Sales Use Case: Additional standards for sales enablement and customer engagement content

Where use case-specific standards impose additional or more stringent requirements than this general Content Policy, the more stringent standard shall prevail.

8. UPDATES TO CONTENT POLICY

8.1 Right to Update

Hyperstate reserves the right to update this Content Policy to: (a) comply with new or changed laws and regulations; (b) address emerging content issues or threats; (c) improve platform safety and user experience; (d) reflect industry best practices; or (e) as otherwise deemed necessary.

8.2 Notice and Acceptance

Customer will be notified of material updates at least 30 days in advance via: (a) email to registered account email; (b) in-platform notification; and (c) updates posted to this URL. Continued use of Platform constitutes acceptance of updated standards.

8.3 Objection Rights

If Customer objects to material changes that reduce content flexibility or impose new restrictions, Customer may: (a) provide written notice of objection within 30 days; (b) work in good faith with Hyperstate to resolve concerns; or (c) terminate the Agreement without penalty if objection cannot be resolved.

8.4 Grandfather Provisions

Existing Content complying with standards at time of upload may be grandfathered with: (a) reasonable time to bring Content into compliance with updated standards; (b) good faith effort to comply required; (c) no guarantee of indefinite grandfathering; (d) illegal content must be removed immediately regardless of when uploaded; and (e) Hyperstate may require compliance with updated standards if necessary for legal or safety reasons.
